By using this website and or purchasing any items listed for sale, you are agreeing to the following terms as outlined in this document.

This site is owned and operated by Keltic Creative Ltd having their registered office based in Dublin, Ireland Reg number 275508. These Terms & Conditions govern the sale of original artwork, Prints and Limited Edition Prints of the artwork along with various other items, created by the Artist Paul Kennedy, Keltic Creative

Definitions

  • Original Artwork: An Artwork created by the Artist, Paul Kennedy
  • Prints: A reproduction of the Artist’s original artwork
  • Limited Edition Prints: A reproduction of the Artist’s original artwork limited to and indicated print run and size, each print signed, embossed with the company seal and numbered by the Artist.
  • Artworks: Any item listed for sale on this website
  • User: Any Person using this website
  • The Company: Keltic Creative Ltd
  • The Artist: Paul Kennedy
  • Purchaser or Buyer: Person that purchases Artwork or items from this website
  • Target Delivery Date: Projected delivery date based on item purchased and the destination of that item

Pricing & Payment

  • All prices for the Artworks are listed in Euro. Where possible the Home Currency for the User will be optional, and we will allow the User to make the Purchase in the Currency
  • Prices are subject to change without notice
  • Payment for the Artwork is due at the time of Purchase. Accepted payment methods are listed on the Checkout Page on this website.
  • By completing and submitting the electronic order form at the Checkout Page you are making an offer to purchase the Artwork in your basket, which if accepted will result in a legally binding contract between you and the Company
  • By making that offer to Purchase Artwork you are authorising Keltic Creative Ltd to deduct the agreed amount from the Card or Payment Method selected on the Order Form. We will confirm acceptance of your order by email to the address you provided, confirming that your Order has been received. Whether or not you receive an email, out acceptance of your Order will create a legally binding contract between us. Where we cannot fulfil your order, we will refund you in respect of the goods paid for but not available.

Shipping & Delivery

  • All Artworks will be shipped within 5 working days after payment is received and cleared
  • Shipping costs for Original Artwork needs to be confirmed and agreed by email or Post prior to purchase of the Original piece.
  • Shipping costs for all Artworks other that Original Artwork is calculated at the Checkout Page
  • The Company and its Shipping Suppliers will endeavour to keep the Purchaser of all Artworks up to date on all delivery schedules.
  • The Company can not take responsibility for any delays in the delivery schedule.
  • The Company agrees to refund the Purchaser for any Artworks, excluding original Artwork that will only be shipped on an Insured basis, that are deemed to be greater than 30 days late from the Target Delivery Date
  • Any damage in Transit must be notified immediately on receipt of delivery. Documented Photographic Evidence must be recorded and provided to the Company. Damage to Packaging must be recorded before unwrapping the Artwork

Returns & Cancellations

  • Original Artwork: Sales of Original Artwork are final, returns are not accepted unless the Artwork is damaged during shipping at which time there may or may not be an Insurance claim.
  • The Purchaser has the right to return purchased Artwork within 14 days of receipt of the same. Items must be returned in perfect condition and at the Purchaser’s own expense.
  • Intention to return items must be notified to the Company within 14 days of receipt of the item(s)

Ownership & Copyright

  • Original Artwork: The purchase of Original Artwork includes the ownership of the physical piece but does not transfer any intellectual property rights, such as Copyright. The Artist retains Copyright to the image.
  • Prints & Limited Edition Prints: The purchase of Prints and Limited Edition Prints grant the buyer ownership to the physical print but does not transfer any intellectual property rights. The Artist retains Copyright to the image.
  • Buyers of any Artwork by the Artist may not reproduce, sell, or use the image of the Artwork for any Commercial purposes without having received written consent by the Artist

Limited Edition Prints

  • Selected Artwork will be offered by the Artist on a Limited Print basis. The Limited Edition Print will be produced in high quality Archival ink on 305gsm Fine Art Archival Paper. Each Edition will have a limited print and size run.
  • Each Print will be signed and numbered by the Artist. The Edition will be considered complete once the Maximum number of prints per size has been reached.
  • Once an Edition is Sold Out no further Prints of that Artwork will be produced

Authenticity

  • The Artist guarantees the authenticity of all Original Artwork, Prints, and Limited Edition Prints for sale on this website.
  • A Certificate of Authenticity will be included with each Original Artwork. A Certificate of Authenticity will be included with each Limited Edition Print detailing the Title of the Artwork, the Limited Edition Number, Date of Issue, size of the print and the Paper Quality.
  • Each Print will be signed and Proof Embossed by the Artist

Condition of Artwork

  • Original Artworks are sold ‘as-is’ and may show minor imperfections due to the nature of the Medium or painting process
  • Prints and Limited Edition Prints are produced with the highest possible care to ensure the highest quality reproduction. Slight variations are always possible due to the printing process.

Privacy & Security

  • The Artist respects your Privacy. Any personal information provided by the Buyer will be used solely for the purpose of processing the order. The Buyer may opt in to receive further and future information and details from the Artist
  • Payment information is processed securely and is not stored by the Artist

Limitations of Liability

  • The Artist is not responsible for any direct, indirect, incidental, or consequential damages arising from the purchase, use, or inability to use the Artwork
  • The Artist makes no warranties, express or implied, regarding the Artwork’s durability, longevity or suitability for a particular purpose.

Governing Law

These Terms & Conditions are governed and construed in accordance with the Laws of Republic of Ireland. Any disputes arising out of, or in connection with the sale of Artwork will be subject to the exclusive jurisdiction of the Courts of Republic of Ireland.

Amendments

The Artist reserves the right to modify these Terms & Conditions at any time. Any changes will be posted on this page and will take effect immediately upon posting.
